These Terms of Use (“Terms”) are an agreement between you and OYEN INDUSTRIES
(“My Genius”, “we”, “us”) governing your
use of mygenius.ng, app.mygenius.ng, and related features (the “Services”). By
using the Services or signing in, you agree to these Terms and to our Privacy Policy. If you do
not agree, please do not use the Services.
1. Eligibility
The Services are built for tertiary students and users aged 18 and above. By using them you confirm you are at least 18, or that you are between 13 and 18 and using the Services with the consent and involvement of a parent or guardian. The Services are not intended for children under 13.
2. Your account
You sign in with Google; we do not manage passwords. You are responsible for the activity on your account and for keeping your device and Google account secure. Provide accurate profile information (such as your university and department) and keep it up to date. Tell us at [email protected] if you suspect unauthorised use of your account.
3. Acceptable use
When using the Services, you agree not to:
Break the law or infringe anyone’s rights, including copyright.
Upload content that is unlawful, harmful, misleading, defamatory, or that you do not have the right to share.
Cheat, manipulate leaderboards or scores, or interfere with the fairness of the platform.
Attempt to gain unauthorised access, probe or breach security, scrape at scale, or overload the Services.
Reverse engineer, resell, or commercially exploit the Services without our written permission.
Impersonate others or misrepresent your affiliation.
4. Your content
“Your content” means anything you submit, such as study notes, files, questions, or requests. You keep ownership of your content. By submitting it, you grant My Genius a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, and display it for the purpose of operating and improving the Services and making it available to other students.
You confirm you have the right to share what you upload and that it does not infringe anyone’s rights or breach any exam, institutional, or confidentiality rules. We may review, moderate, edit, or remove content — including questions generated from your uploads — before or after it appears, and we are not obliged to publish anything.
5. Educational content & AI
My Genius is a study aid, not an official source of truth. Quiz questions, AI-generated summaries, and other learning material may contain errors or omissions and are provided for practice only. Always verify against your course materials and lecturers. My Genius is not affiliated with, endorsed by, or an agent of any university, and using it does not guarantee any academic result.
6. Donations
Donations are voluntary and help keep the Services running. They are processed by our payment partner; we never receive your card or full bank details. Unless required by law, donations are non-refundable. If a payment is charged in error, contact [email protected] and we will look into it. Donating does not purchase any product, guarantee, or preferential treatment, though we may recognise supporters (for example on a donor leaderboard).
7. Intellectual property
The Services, including the My Genius name, logo, design, and software, are owned by OYEN INDUSTRIES and protected by intellectual property laws. We grant you a limited, personal, non-transferable licence to use the Services for their intended purpose. All rights not expressly granted are reserved.
8. Third-party services
The Services rely on third parties such as Google (sign-in), Groq (AI summaries), Cloudinary (file hosting), and SafeHaven MFB (donations). Your use of those features may also be subject to the relevant provider’s terms. We are not responsible for third-party services we do not control.
9. Availability & changes to the Services
We are a small, student-built team and offer the Services on an evolving basis. We may add, change, suspend, or discontinue features at any time, and we do not guarantee uninterrupted or error-free availability. We will try to give reasonable notice of significant changes where we can.
10. Disclaimers
The Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law. You use the Services at your own discretion and risk.
11. Limitation of liability
To the fullest extent permitted by law, My Genius and OYEN INDUSTRIES will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of data, academic outcomes, profits, or goodwill, arising from your use of the Services. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
12. Termination
You may stop using the Services and request account deletion at any time by contacting [email protected]. We may suspend or terminate access if you breach these Terms, misuse the Services, or where necessary to protect users or comply with the law. Provisions that by their nature should survive termination (such as content licences already granted, intellectual property, disclaimers, and liability limits) will continue to apply.
13. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria, and any disputes are subject to the jurisdiction of the Nigerian courts. Our handling of personal data also follows the Nigeria Data Protection Act 2023, as described in our Privacy Policy.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Continuing to use the Services after an update means you accept the revised Terms.
